Terms and Conditions for Online Reservations

  1. A person (the “Applicant”) that may be interested in reserving a property may apply online to reserve the property for a period of 10 (ten) days (the “Reservation Period”).
  2. Once the Applicant has selected a property (the “Property”), the Applicant will be required to make a payment in the sum of AED20,000 (United Arab Emirates Dirham twenty thousand) (the “Reservation Payment”) to reserve the Property for the Reservation Period. The Reservation Payment will be considered as paid only after cleared funds have been received.
  3. The Applicant will then be contacted by ARADA DEVELOPMENTS LLC (“ARADA”) and provided with a document being an offer by the Applicant to purchase the Property in accordance with the terms and conditions contained therein (the “Reservation Contract”).
  4. During the Reservation Period, the Applicant can elect to either:
    1. Sign and deliver to ARADA the original Reservation Contract, together with the first instalment required under the Reservation Contract and such supporting documents as required by ARADA (the signing of the original Reservation Contract and delivery to ARADA represents an offer by the Applicant to purchase the Property); or
    2. Notify ARADA in writing that the Applicant does not intend to offer to purchase the Property.
  5. In the event that during the Reservation Period the Applicant delivers to ARADA an original signed Reservation Contract together with the first instalment required under the Reservation Contract and satisfactory supporting documents, and always subject to clearance of the Reservation Payment, ARADA may counter-execute the Reservation Contract whereupon:
    1. The Reservation Contract shall constitute the only contract between the Applicant and ARADA in respect of the Property; and
    2. The Reservation Payment shall be credited towards the first instalment under the Reservation Contract.
  6. In the event that during the Reservation Period the Applicant instead notifies ARADA in writing that the Applicant does not intend to offer to purchase the Property, then:
    1. In not less than 30 days following such notification, ARADA shall refund to the Applicant the Reservation Payment; and
    2. ARADA shall be free to reserve, deal with, or dispose of the Property for or to any third party in its absolute discretion.
  7. In the event that during the Reservation Period:
    1. ARADA is unable to make contact with the Applicant or is unable to send or deliver the Reservation Contract to the Applicant; or
    2. the Applicant does not notify ARADA that he/it intends to sign and deliver the Reservation Contract; or
    3. the Applicant does not deliver an original signed Reservation Contract to ARADA; or
    4. for whatever reason cleared funds of the Reservation Payment are not made: -

it shall be deemed that the Applicant does not intend to offer to purchase the Property or to deliver to ARADA a signed Reservation Contract and the provisions of clause 6 above will apply and ARADA shall, without prejudice to any other of its rights under this online application or at law, and without liability, have the right, but not the obligation, at its sole discretion, to decline or cancel this online application.

  1. Real estate agents or brokers shall not be permitted to reserve any properties online for commercial purposes.
  2. The advertising of the properties and this online application do not constitute, nor does ARADA represent that they constitute, a transaction involving or an agreement for the sale and purchase of property or a promise to sell property by ARADA.
  3. The Applicant confirms, warrants and represents each of the following is true and correct:
      1. The details provided by the Applicant in the online application are accurate to the best of his/its knowledge.
      2. The Applicant has full authority, power and capacity to make and perform this online application and does so at his/its own risk and liability.
      3. the Applicant is of full legal age.
      4. The monies used by the Applicant for any payment made under this online application originate from clean funds and are not and could not reasonably be considered to be the subject matter of money laundering in any way whatsoever and comply with all applicable laws in relation to money transfers.
      5. The Applicant is reserving the Property for him/itself.
      6. The Applicant is not a real estate agent or broker, nor is the Applicant acting on behalf of a real estate agent or broker to reserve the Property for commercial purposes.
      7. The Applicant has read, understood and agreed to the terms and conditions and privacy policy contained in this website.
  1. In the event that any of the confirmations, warranties or representations contained in clause 10 are untrue, the Applicant shall indemnify ARADA for any loss or claims arising as a result, and ARADA shall have the right to decline or terminate this online application whereupon the provisions of clause 6 shall apply.
  2. The Applicant acknowledges and agrees that while ARADA will make best efforts to reserve the Property selected for the Applicant, an event beyond its reasonable control (including a technical error) may occur which may result in the Property selected by the Applicant no longer being available for reservation. In such a case the Applicant will be entitled to either withdraw or terminate this online application by giving written notice to ARADA, whereupon the provisions of clause 6 shall apply, or reserve a different property of similar value (as determined and agreed by ARADA in its discretion acting reasonably).
  3. This online application is exclusive to the Applicant and the Applicant may not at any time transfer or assign his/its rights and obligations under it to any third party, and any such transfer, assignment, or attempt, shall be invalid.
  4. ARADA may assign or novate its rights and obligations under this online application to a nominee or affiliate by giving notice to the Applicant and the Applicant hereby consents to any such assignment or novation, and the Applicant agrees to sign all documents and do all things that may be required to give effect to the assignment or novation.
  5. This online application may be declined or terminated by ARADA at any time without having to state reasons and ARADA, its directors, employees, agents and affiliated companies and entities shall not be liable to the Applicant other than to refund to the Applicant the Reservation Payment. ARADA, its directors, employees, agents and affiliated companies and entities shall not be liable to the Applicant or to any other person in relation to any other matters arising out of this online application, and the Applicant shall indemnify them, against all such claims, demands or liabilities, except as otherwise provided herein.
  6. In the event that any part of this online application shall be void or unenforceable by reason of any applicable law, it shall be deleted and the remaining parts of this online application shall continue in full force and effect.
  7. This online application shall be governed by and construed in accordance with the laws of the Emirate of Sharjah and the applicable laws of the United Arab Emirates and any dispute arising out of or in connection with this online application including any question regarding its existence, validity or termination, shall be referred to the exclusive jurisdiction of the Courts of the Emirate of Sharjah.
  8. Notwithstanding these terms and conditions have been prepared in English and Arabic, in the event of a dispute over the interpretation of the provisions of this online application, the English version shall prevail.
  9. These terms and conditions may be amended from time to time without notice.
